Implementation Procedure [Appeal to the Digital Ombudsman]

The person responsible for the procedure is the Digital Ombudsman who appoints an Investigating Officer responsible for carrying out the investigative activities. Anyone can submit reports to the Digital Ombudsman regarding alleged violations of the CAD and any other regulation on digitalization and innovation of public administration by the subjects referred to in article 2, paragraph 2 of the CAD.

The report must be transmitted by the interested party electronically by filling out the form on the AgID website by accessing the appropriate area on the AgID website through SPID or CIE.


The report must contain the identification data of the reporting person and the exact indication of the reported entity, as well as an express declaration of responsibility regarding the information provided and any documents produced, issued pursuant to Presidential Decree 445/2000. These data and declaration constitute essential elements of the report, without which the Digital Ombudsman declares the inadmissibility of the report itself.


There will be no communication from AgID except in the case of initiation of proceedings. The report is considered closed with an archiving if no proceedings are initiated within 90 days of receipt.


If the report leads to the initiation of proceedings, the data of the reporting person will be processed for the management of the report, including the communication of the report to the reported entity. Any specific and motivated anonymity requirements must be declared at the time of reporting.


The Complaint and the Report may be deemed inadmissible for the following reasons:

  • Incompetence of the Digital Ombudsman, also taking into account the institutional competences of the Agency;
  • Excessive generality or indeterminacy;
  • Lack of information elements;
  • Identity of the complaint or report with another for which a provision has already been issued;
  • Multiple service providers indicated in the same report;



In the cases referred to in paragraph 1, the Digital Ombudsman proceeds to order the dismissal of the Complaint or Report.



INITIATION OF PROCEEDINGS
The Person in charge communicates the initiation of proceedings to the service provider except in cases where the report is declared inadmissible pursuant to art. 6 of this Regulation. The communication of initiation of proceedings contains: a) the indication of the Person responsible for the procedure; b) the object of the assessment; c) the indication that the procedure will be concluded within 120 days, except for any suspensions indicated in this Regulation.



INVESTIGATION
The investigation phase concludes within 90 days from receipt by the Digital Ombudsman of the report or complaint complete with all documentation. During the investigation, the Digital Ombudsman may request information or documents from the reporting person and/or the service provider, with indication of a peremptory deadline of 15 days for response, also communicating that in case of no response, the procedure will continue with only the elements available. Where necessary during the investigation, the person responsible for the procedure may request information or opinions from other Offices/Services of the Agency.
